The meeting was called to order at 9:00 am. In attendance were Supervisors Brandt, Peterson, and Wortham, and the Clerk.
Supervisor Brandt explained the history of the private home rental issue and his research on it. He had spoken with Mr Kvam several times, had contacted the county, state, & the township association, and had looked through information provided on the issue. He spoke with Chris Pence to find out about the county’s position from a zoning perspective. Mr Pence had said he would follow up on complaints. The MN Department of Health has some regulations that may apply, but its unclear what they can do for enforcement. The township association attorney is serving on a task force that is looking at the issue – they reported that current legislation is not very clear in reference to private home rentals. Brandt noted that Mr Kvam is pursuing action at the county level to limit rentals, but was willing to help the township update the comprehensive plan to include language on the issue. Brandt also spoke with the township’s attorney, Gerry Brine, who pointed out that the board can choose whether to respond the petition, but an ordinance would have to be enforced and administered by the township.
Motion by Wortham, second by Peterson to not pursue ordinance to regulate private home rentals at this time. Carried unanimous.
Brandt commented that the board still has options to respond to the issue after receiving more info from the township association and the MDH. Peterson noted that residents should pursue all currently available legal actions before seeking further regulations. Brandt responded that the many times the responsible person, the home owner, is not available locally, so its often difficult to get action quickly as issues arise. He feels the state needs to clarify language defining the issue, and the county has to take a position to regulate & enforce.
Motion by Peterson, second by Wortham to work with the township association to introduce legislation to update the state rules, and to work with the county zoning department to pursue helpful changes. Carried unanimous. Peterson will report to the board as progress is made.
