Road Vacation Hearing August 25, 2016

The hearing was called to order at 10:00 am.  In attendance were Supervisors Peterson, Bilek, and Johnson, Counsel Brine, and the Clerk. John Wicklund and Bill Wortham were also present.

Peterson cited the Order Setting Forth Initial Descriptions and Setting Hearing Date which was ordered on August 9th, 2016 as provided by Minn. Stat. §164.07. He noted that the Board had received a petition with the required 8 signatures, that the affected property owner had been served notice, the hearing notice was published in the Northland Press on August 19th , and posted at the town hall & website. No waterfront was involved so notification of the DNR was not required.

The road to be vacated was described as follows:

That portion of the public road described as: Trout Lake Camp Drive lying to the easterly of a point 500 fee east, more or less, from the intersection of Trout Lake Camp Drive and Wabigoniss Shores Road and 30 feet east, more or less, from the intersection with Red Pine Trail, located in Section 2, Township 137 North, Range 28 West, Crow Wing County, Minnesota.

Counsel Brine gave information regarding options available to the board and the process required for each.

Findings of fact were presented as follows:

  1. Supervisors Bilek and Peterson have examined the area and agree with the description.
  2. No public interest in road as area to be vacated completely within the Trout Lake Camp property.
  3. Representatives of Trout Lake Camp requested the vacation as they want to install a gate to control access and provide security for the camp main campus.
  4. The Township benefits by reducing required maintenance for the road.

There were no public comments.

Johnson asked Wicklund to confirm that the camp was in full support of the action and he replied affirmative.

Motion by Johnson, second by Peterson to approve the road vacation, and revert the property to the current owner which is Minnesota-Iowa Baptist Conference. Carried unanimous, with Bilek recused due to being a party on the petition.

There being no further business to conduct, the meeting adjourned at 1:45 pm.
