Kehring Cartway Hearing January 9th, 2006 The Hearing was opened by Supervisor Brandt at 5:00 pm.
All Board members were in attendance. Attorney Ray Charpentier was present along with the petitioners, the Kehrings. Suzanne and Ted Merickel and legal representation for James Schumacher, Tom Pearson, were also in attendance for the Hearing. Supervisor Brandt asked if the attending parties wished to try and negotiate a private agreement before the hearing began. No agreement was reached. Supervisor Brandt requested legal council for the Township, Gerry Brine, summarize the legal process regarding the petition for the Cartway. Brine reported the Township Board accepted the Petition on June 13th, 2005 based on the findings of fact. Brine requested the Clerk read the minutes of the June 13th, 2005 for the record. Jim Runberg, appraiser, was requested to give a summary of the appraisal for each property affected by the Cartway. The Hermel property was appraised at $3.5 million dollars with damages of $1,500 caused by the construction of the Cartway. The Merickel property was appraised at $1.25 million dollars with damages of $600 caused by the construction of the Cartway. The Schumacher property was appraised at $1.9 million dollars with damages of $32,600 caused by the construction of the Cartway. Supervisor Brandt opened the floor to comment from other interested parties in attendance. Tom Pearson, representing James Schumacher, expressed concern regarding the 2 acres requirement for a Cartway. A discussion regarding the previous findings took place. The Board agreed the findings established the 2 acre minimum required and no new information provided by Mr. Pearson suggest otherwise. Mr. and Mrs. Merickel raised several concerns they had regarding the Cartway and their property. Supervisor Brandt made a motion to recess the Hearing and reconvene after the scheduled January Board meeting. Carried - unanimous The Hearing recessed at 6:50 pm and reconvened at 8:40 pm. The Board had a lengthy discussion regarding damages. Motion by Brandt to award the following damages based on the appraisals by Mr. Runberg: Hermel - $1,500 in damages Merickel - $600 in damages Schumacher - $25,000 in damages and $7,600 in land for a total of $32,600
Carried - unanimous. Several conditions were set forth by the Board regarding the Cartway. - A road maintenance agreement is required between the affected parties before the Cartway is constructed. If an agreement cannot be reached within 30 days between the parties, the Board would set up a maintenance agreement for the parties.
- Minimize the size of the Cartway.
- No expansion of the existing paved surface along the Merickel property.
- Any damages to the existing surface would be paid for by the party doing the damage.
Motion by Brandt to have Gerry Brine compose the Resolution and present it to the Board for approval. Carried - unanimous. The Hearing adjourned at 9:40 pm. Deana St. Pierre Ideal Township |
